If you do not agree to these Terms, please do not use our website or services. TalonTyr reserves the right to update these Terms at any time. Continued use of our website or services following any update constitutes your acceptance of the revised Terms.

TalonTyr is an AI automation agency that designs, builds, and manages done-for-you automation systems for local businesses using GoHighLevel (GHL) as our primary platform. Our services include:

• AI-powered web chat Sales Agents deployed on client websites
• Voice AI receptionists that handle inbound calls and book appointments automatically
• Automated lead capture, follow-up, and nurture sequences via SMS, email, and voice
• Appointment booking and reminder automation
• Reputation management and automated review generation campaigns
• Customer reactivation campaigns targeting lapsed contacts
• CRM setup, pipeline management, and contact organization
• Ongoing system management, optimization, and reporting

Services are provided under three tiers: Foundation, Growth, and Elite. Specific deliverables, pricing, and terms for each engagement are set forth in a separate service agreement. By engaging TalonTyr's services, you acknowledge that your contact and communication data will be processed within the GoHighLevel platform.

By using talontyr.com or engaging TalonTyr's services, you agree to:

• Provide accurate, complete, and current information when submitting forms, booking calls, or entering into a service agreement
• Maintain the confidentiality of any account credentials or access links provided to you
• Use TalonTyr's website and services only for lawful purposes and in accordance with these Terms
• Notify TalonTyr promptly of any unauthorized use or security concerns at hello@talontyr.com
• Comply with all applicable federal, state, and local laws in connection with your use of TalonTyr's services
• Ensure that any contact lists or customer data you provide to TalonTyr have been collected lawfully and with appropriate consent

As a client, you are responsible for ensuring that your own customers and contacts have consented to receive the communications that TalonTyr's systems will send on your behalf. TalonTyr is not responsible for legal violations arising from client-provided contact data collected without proper consent.

You agree not to use talontyr.com or TalonTyr's services to:

• Violate any applicable law, regulation, or third-party right
• Send unsolicited commercial messages or contact individuals who have not opted in
• Transmit content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt TalonTyr's systems or third-party platforms including GoHighLevel
• Attempt to gain unauthorized access to any system, account, or data
• Send communications to contacts who have previously opted out or requested to stop receiving messages
• Harvest, scrape, or collect information from talontyr.com without written consent
• Use TalonTyr's systems in any manner that could expose TalonTyr to liability under the TCPA, CAN-SPAM Act, or any applicable communications law

TalonTyr reserves the right to suspend or terminate access for any user or client who violates these provisions, without prior notice and without refund.

Message Description

When you opt in to receive SMS messages from TalonTyr, you may receive: appointment confirmation and scheduling notifications, appointment reminders prior to scheduled calls or meetings, follow-up messages after submitting an inquiry or request form on talontyr.com, service-related updates and notifications relevant to your engagement with TalonTyr, and responses to inbound messages you send to us.

How to Opt Out

You can cancel the SMS service at any time. Just text STOP to 325-297-1071. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

No Sharing of SMS Consent Data

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except for aggregators and providers of the text message services required to deliver your messages. This consent data is never sold, rented, or transferred for independent marketing use by any third party.

TalonTyr's services are provided under a setup fee plus monthly retainer structure. Specific pricing, payment terms, and billing cycles are set forth in the service agreement for each client.

General Payment Terms

• Setup fees are due at the time of engagement and prior to commencement of any build work
• Monthly retainer fees are billed in advance on the client's billing date
• Payments are processed securely through Stripe
• All fees are non-refundable unless otherwise specified in the client's service agreement
• TalonTyr reserves the right to suspend services for accounts with overdue balances after reasonable notice

Disputed Charges

If you believe a charge is incorrect, contact TalonTyr at hello@talontyr.com within 15 days of the charge date. TalonTyr will review the dispute and respond within 10 business days. Initiating a chargeback without first contacting TalonTyr may result in immediate service suspension.

Price Changes

TalonTyr reserves the right to modify its pricing. Existing clients will receive at least 30 days written notice before any price change takes effect on their account.

TalonTyr's IP

All content on talontyr.com, including text, graphics, logos, images, and the TalonTyr name and brand, is the property of TalonTyr and Ross Momentum LLC and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works without TalonTyr's prior written consent.

Client IP

TalonTyr does not claim ownership of any content, brand assets, or data that clients provide in connection with service delivery. Client-provided materials remain the property of the client. By providing materials to TalonTyr, you grant TalonTyr a limited license to use those materials solely for the purpose of delivering the contracted services.

Work Product

Unless otherwise specified in a client's service agreement, automation systems, workflows, funnels, and configurations built by TalonTyr within a client's GoHighLevel sub-account are licensed to the client for use during the active service engagement. The underlying frameworks, templates, and methodologies developed by TalonTyr remain TalonTyr's proprietary intellectual property.

TalonTyr's website and services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

TalonTyr does not warrant that:

• The website or services will be uninterrupted, error-free, or completely secure
• Any specific business results, revenue increases, or lead generation outcomes will be achieved
• Third-party platforms including GoHighLevel, Twilio, or Stripe will be available without interruption
• SMS messages will be delivered successfully to all recipients due to carrier filtering or network conditions outside TalonTyr's control

TalonTyr makes no guarantees regarding A2P 10DLC campaign approval by wireless carriers. Carrier approval decisions are made independently and are not within TalonTyr's control.

To the maximum extent permitted by applicable law, TalonTyr and Ross Momentum LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, loss of data, or business interruption, arising from your use of or inability to use TalonTyr's website or services.

TalonTyr's total liability to you for any claims shall not exceed the total amount paid by you to TalonTyr in the three months immediately preceding the claim.

You agree to indemnify, defend, and hold harmless TalonTyr, Ross Momentum LLC, and their respective members, managers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising from or related to:

• Your use of talontyr.com or TalonTyr's services
• Your violation of these Terms
• Your violation of any applicable law or third-party right
• Any contact data or content you provide that infringes any third-party right or violates any law
• Any unauthorized communications sent to your customers as a result of data you provided without proper consent

• Either party may terminate the engagement with 30 days written notice
• TalonTyr may terminate or suspend services immediately without notice for violations of these Terms, non-payment, or conduct harmful to TalonTyr's business or other clients
• Upon termination, TalonTyr will cease all automation activity within the client's sub-account within 5 business days
• Client data will be accessible for 30 days following termination, after which TalonTyr may delete or archive the sub-account
• Monthly retainer fees are not refunded upon early termination unless otherwise specified in the service agreement

TalonTyr's rights regarding intellectual property, limitation of liability, and indemnification survive termination of any service engagement.

These Terms shall be governed by the laws of the State of Texas. Any dispute that cannot be resolved informally shall be submitted to binding arbitration in Tom Green County, Texas, in accordance with the rules of the American Arbitration Association. The prevailing party shall be entitled to recover reasonable attorneys' fees and costs.

You agree that any claim against TalonTyr must be brought within one year of the date the cause of action arose.

TalonTyr reserves the right to modify these Terms at any time. For active clients, TalonTyr will provide notice of material changes via email at least 14 days before the changes take effect. Continued use of our website or services after any changes constitutes acceptance of the revised Terms.

Entire Agreement

These Terms, together with TalonTyr's Privacy Policy and any executed service agreement, constitute the entire agreement between you and TalonTyr regarding the subject matter herein.

Severability

If any provision of these Terms is found to be unenforceable, that provision shall be limited to the minimum extent necessary, and the remaining provisions shall continue in full force.

Waiver

TalonTyr's failure to enforce any right or provision shall not constitute a waiver of that right or provision.

Force Majeure

TalonTyr shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including acts of God, natural disasters, pandemic, government action, or third-party platform outages.
